TERMS AND CONDITIONS
Operated by: Harsh Doshi Aureleaa Private Limited, a company incorporated under the provisions of the Companies Act, 2013, India (hereinafter referred to as the "Company").
1. Scope and Acceptance
These Terms and Conditions ("Terms") govern the access to and use of the Company's website, products, and services. By accessing the website and/or placing an order, the customer ("Customer") expressly agrees to be bound by these Terms, which constitute a legally binding agreement between the Customer and the Company.
2. Product Representation
All jewellery products are handcrafted and may exhibit minor variations in weight, dimensions, finish, and gemstone characteristics. Such variations shall be deemed acceptable and within standard industry tolerances and shall not be construed as defects.
3. Pricing and Taxes
All prices are quoted in Indian Rupees (INR), unless otherwise specified. Applicable Goods and Services Tax (GST) shall be levied in accordance with prevailing laws. For international transactions, the Customer shall be solely responsible for any customs duties, import levies, or local taxes imposed by the destination jurisdiction.
4. Order Acceptance and Formation of Contract
An order placed by the Customer shall constitute an offer to purchase. A legally binding contract shall be formed only upon issuance of a dispatch confirmation by the Company. The Company reserves the right to refuse or cancel any order at its sole discretion, including but not limited to instances involving payment failure, suspected fraud, regulatory non-compliance, or inventory constraints.
5. After-Sales Services
The Company may, at its discretion, provide after-sales services including cleaning, inspection, polishing, resizing (where technically feasible), and repair. Such services shall be subject to technical evaluation and may incur additional charges.
6. Responsible Sourcing and Ethical Standards
The Company sources diamonds and gemstones exclusively from reputable suppliers adhering to recognized ethical sourcing standards, including compliance with the Kimberley Process Certification Scheme, where applicable.
7. Hallmarking and Certification
All gold jewellery, where applicable, is hallmarked in accordance with Bureau of Indian Standards (BIS) regulations. Each product shall be accompanied by a Certificate of Authenticity issued by the Company bearing a unique identification number. Independent certifications, including but not limited to GIA certification, may be provided where applicable.
8. Bespoke and Made-to-Order Products
Bespoke or made-to-order products are customized and manufactured based on Customer specifications. Such orders shall be considered final and non-cancellable once production has commenced, except in cases of proven manufacturing defects.
9. Shipping and Transfer of Risk
Delivery timelines provided by the Company are indicative and not binding. Risk of loss or damage to the product shall pass to the Customer upon confirmed delivery. Any damage incurred during transit must be reported to the Company within forty-eight (48) hours of delivery, failing which no claims shall be entertained.
10. Returns and Refund Policy
Requests for returns must be initiated within fifteen (15) days from the date of delivery. Returned products must be unused, unworn, and in original condition, accompanied by all original packaging, documentation, and certificates. The Company reserves the right to reject returns in cases where products exhibit signs of use, alteration, resizing, tampering, or damage.
11. Delivery Timeline
The estimated delivery period shall be approximately two (2) to three (3) weeks from the date of order confirmation, subject to product availability and production timelines. Any expedited delivery shall be communicated via official correspondence.
12. Intellectual Property Rights
All designs, trademarks, logos, images, text, and other intellectual property displayed on the website or associated materials are the exclusive property of the Company and are protected under applicable intellectual property laws. Unauthorized use, reproduction, or distribution is strictly prohibited.
13. Limitation of Liability
To the fullest extent permitted by law, the Company's total liability arising out of or in connection with any product or service shall not exceed the purchase price paid by the Customer for such product, except where such limitation is prohibited under applicable law.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable law, the courts located in India shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
